Cette l\u00e9gislation, \u00e9tablie par le ministre Dermagne, s&rsquo;applique \u00e0 tous les nouveaux cr\u00e9dits.<\/em><\/p>\n<p>Avec la nouvelle l\u00e9gislation, les personnes qui ont l&rsquo;intention d&rsquo;acheter un logement sont mieux prot\u00e9g\u00e9es. Auparavant, la banque imposait g\u00e9n\u00e9ralement \u00e0 l&rsquo;acheteur de conclure une assurance incendie et solde restant d\u00fb via leur canal pour obtenir ainsi un meilleur taux d&rsquo;int\u00e9r\u00eat. Cela conduisait souvent au fait que le client n&rsquo;avait de cette mani\u00e8re pas toujours les meilleures conditions pour sa police d&rsquo;assurance et \u00e9tait ainsi pris en otage pendant la dur\u00e9e de l&#8217;emprunt hypoth\u00e9caire. Il \u00e9tait fr\u00e9quent que ces contrats ne soient plus revus apr\u00e8s la conclusion de la police d&rsquo;assurance.<\/p>\n<p>Cette \u201cprise d&rsquo;otage\u201d doit \u00e9videmment \u00eatre prise avec la plus grande prudence. L&rsquo;acheteur est libre de conclure une propre assurance qui est ind\u00e9pendante de la banque avec qui il a conclu l&#8217;emprunt hypoth\u00e9caire, mais il ne pourra dans ce cas pas b\u00e9n\u00e9ficier du taux d&rsquo;int\u00e9r\u00eat avantageux. La m\u00eame chose est valable pour l&rsquo;arr\u00eat de la police d&rsquo;assurance pendant la dur\u00e9e du cr\u00e9dit, la banque pouvait l\u00e0 aussi adapter le taux d&rsquo;int\u00e9r\u00eat \u00e9tant donn\u00e9 que celui-ci \u00e9tait appliqu\u00e9 de mani\u00e8re conditionnelle. Peu d&#8217;emprunteurs en sont conscients.<\/p>\n<h2>La nouvelle l\u00e9gislation<\/h2>\n<p><em>La modification de la loi a pris cours le 1er juin 2024 et est uniquement valable pour des contrats de cr\u00e9dit nouvellement conclus. L&rsquo;ancienne l\u00e9gislation continue toujours de s&rsquo;appliquer pour les cr\u00e9dits conclus avant cette date.<\/em><\/p>\n<p><em>Les banques peuvent donc continuer \u00e0 appliquer la vente coupl\u00e9e, mais les r\u00e8gles du jeu ont \u00e9t\u00e9 adapt\u00e9es. Elles peuvent ainsi uniquement continuer \u00e0 coupler les conditions d&rsquo;int\u00e9r\u00eat \u00e0 une assurance solde restant d\u00fb, une assurance incendie, une assurance-caution et un compte de paiement. Le l\u00e9gislateur a \u00e9galement pr\u00e9vu qu&rsquo;apr\u00e8s un tiers de la dur\u00e9e de l&#8217;emprunt hypoth\u00e9caire l&#8217;emprunteur a le droit de r\u00e9silier les assurances compl\u00e9mentaires sans perdre la r\u00e9duction conditionnelle sur le taux d&rsquo;int\u00e9r\u00eat. La banque peut toutefois encore imposer certaines conditions comme la prise d&rsquo;une assurance incendie similaire aupr\u00e8s d&rsquo;un autre assureur.<\/em><\/p>\n<p>Les consommateurs b\u00e9n\u00e9ficieront ainsi d&rsquo;une plus grande libert\u00e9 de choix et d&rsquo;une meilleure protection, ce qui est certainement une bonne chose. D&rsquo;un autre c\u00f4t\u00e9, cela signifie que pour les nouveaux contrats, cela ne sera possible qu&rsquo;apr\u00e8s 7-8 ans, \u00e9tant donn\u00e9 que de nombreux pr\u00eats hypoth\u00e9caires ont de toute fa\u00e7on une dur\u00e9e de 25 ans.<\/p>\n<h2>L&#8217;emprunt hypoth\u00e9caire est rembours\u00e9 ? Faites revoir vos polices d&rsquo;assurance.<\/h2>\n<p>Si vous \u00eates lib\u00e9r\u00e9 de l&#8217;emprunt hypoth\u00e9caire sur votre logement, vous n&rsquo;\u00eates de toute fa\u00e7on plus tenu de conserver les polices d&rsquo;assurance aupr\u00e8s de la banque.
